Entry Rules
- CONTEST PERIOD
The "NFL Sunday Ticket - Who's Your Team Fantasy Football Pool" Contest (the "Contest") is run by Bell Canada (the "Sponsor") and will take place in Canada from 6:00:01 a.m. (EST) on Monday, August 21, 2006 to 11:59:59 p.m. (EST) on Sunday, December 31, 2006 (the "Contest Period").
- CONTEST GROUP ENTITIES
For the purposes of the Contest, the "Contest Group" is composed of the Sponsor, NFL (the National Football League), Canoe Inc., Hitachi Canada Ltd., Plain and Simple together with their affiliates (including without limitation the parent, sister and subsidiary companies), retailers, franchisees, advertising and promotion agencies, suppliers of material and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest (collectively, the "Contest Group Entities").
- ELIGIBILITY
The Contest is open to all individuals who are legal residents of Canada who have reached the age of majority in the province or territory in which they reside as of the date of entering the Contest.
Employees of Contest Group Entities, as well as members of the immediate family (such as their father, mother, brothers, sisters or children) of such employees, their legal or common-law spouses or any persons with whom such employees reside are not eligible to enter the Contest.
- METHODS OF ENTRY
- There are two methods of entry into the Contest.
- First Method of Entry: An entrant must be a Bell ExpressVu subscriber with an account in good standing and must also subscribe to the Bell ExpressVu NFL Sunday Ticket package, 2006 season. Once the entrant has satisfied the above mentioned requirements, she or he may enter the contest pool ("Contest Pool") as set out in section 4.8.
- Second Method of Entry: The second method of entry is a no purchase method of entry. An entrant may enter the contest without purchase by visiting the website www.bellfantasyfootball.com and submitting an original essay (no more than 500 words) telling us "Who's Your NFL Team" and why you feel that you are the ultimate NFL fan. Included with each essay must be your full name (including middle initial), address (including postal code) and daytime telephone number (including area code), Bell ExpressVu account number (if applicable) and e-mail address. Once an entrant has satisfied the above mentioned requirements, she or he may enter the contest pool ("Contest Pool") as set out in section 4.8.
- No Purchase Necessary: Although online access and an e-mail account are required in order to participate, many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free e-mail accounts.
- Contest Close Date for the Grand Prize, Second and Third Prize: Entries must be received by no later than 11:59:59 p.m. (EST) on Sunday, December 31, 2006
- Weekly Contest Close Dates: To be eligible to win weekly prizes, entries must be received by noon on the Sunday of that particular week starting with Sunday September 10th and every Sunday continuing until Sunday December 31st, 2006.
- Limit of Entries: There is a limit of one (1) entry per person and per address during the Contest Period, regardless of the method of entry.
- The Contest Pool: Once an entrant has satisfied the requirements as set out in 4.2 and 4.3 above, she or he may then enter the contest pool ("Contest Pool") as follows:
In order to participate in the Contest Pool, the entrant must take the following steps:
- Log onto the Contest website at http://www.bellfantasyfootball.com;
- Register for the Contest Pool by entering his/her full name (including middle initial), address (including postal code) and daytime telephone number (including area code) e-mail address and Bell ExpressVu account number (if applicable);
- Once registered, the entrant will access a list of players that are playing in the next Sunday's NFL Sunday Ticket games;
- From this predetermined list, entrants are required to pick their fantasy players on a fantasy team for that Sunday from the following positions:
2 quarterbacks
2 running backs
2 wide receivers
1 tight end
- The Sponsor will count the points accumulated and entrants will receive points based solely on the total yardage each of their chosen players has accumulated during that Sunday's game (one point per yard gained).
- On the following Tuesday morning, entrants will receive an email showing their performance for that Sunday (accumulated points plus where they are in the ongoing standings) and will be given a link which they can click on in order to go to a web page where they can select their team for the following Sunday;
- The entrant with the most points accumulated until December 31st, 2006, will win the Grand prize. The entrant with the second most points accumulated until December 31st 2006, will win the second prize; the entrant with the third most points will win the third prize; the most points in one week for that particular week, wins a weekly prize; and
- In the event of a tie for any prize(s), the entrants who are tied will be entered into a draw. The name drawn by the Sponsor will be the winner of that particular prize.
- PHOTO SUBMISSIONS
- Entrants entering the Contest via 4.2 or 4.3 above may submit up to three photographs illustrating how passionate she or he is about her or his favourite NFL team (the "Submission(s)"). The Submission has no effect on the chances of winning. If an entrant chooses not to submit a photo, the entry is still valid.
- The Sponsors in its sole discretion may post selected Submissions on http://www.bellfantasyfootball.com until the end of the Contest or such time as the Sponsor decides in its sole discretion. All Submissions become the property of the Sponsor.
- Entrants may submit a photograph as follows:
Entrants may submit a photograph by accessing the registration page on the fantasy pool website at http://www.bellfantasyfootball.com.
Once on the website the entrant must fill out the requisite information and specify that he/she is not a Bell ExpressVu subscriber and/or is not a Bell ExpressVu NFL Sunday Ticket package subscriber. The option to submit a photo will be available directly below the essay submission section on the page.
- Restrictions on Photo Submissions:
- The Submission must be in .jpg or .gif format, size 100kb or less;
- The Submission submitted by an entrant as otherwise provided in these contest rules must be the original work of the entrant, must not copy, reproduce or otherwise use, in whole or in part, without the express written consent of the owner thereof, any trade-mark, copyright-protected work or other intellectual property of any third party, must not contain the image, likeness, name, voice, statements or other identifying characteristics (individually or collectively, the "Image") of any person who has not provided the entrant with his/her express written consent to such use of his/her Image and must not contain or depict any pornography, libel, slander, obscenity, profanity, threatening, degrading or demeaning language, symbols or behaviour or other material which may, in the opinion of the Sponsors, in their sole and absolute discretion, offend prevailing community standards of decency or appropriateness;
- By entering this contest, entrants acknowledge and agree that all Submissions are subject to review and /or editing by the Sponsors, in the sole and absolute discretion of such Sponsors. The Sponsors also reserve the right to require any entrant to provide satisfactory proof of any third-party consent which appears to the Sponsor, in their sole and absolute discretion, to be required in respect of any entry; and
- By entering this contest, each entrant (i) consents to the broadcast, publication and/or use, in any medium whatsoever, including without limitation on the website, of the entrant's entry, name, city of residence, statements, photograph and/or other image or likeness, in whole or in part and as edited, if applicable, as contemplated herein, without payment or compensation of any kind;(ii) represents and warrants that the Submission submitted by such entrant complies in all respects with these contest rules, including without limitation the restrictions on Submissions set forth herein; (iii) assigns to and in favour of the Sponsor all copyright, intellectual property and other rights of any kind in and to each Submission submitted by such entrant and hereby waives, in favour of the Sponsor and its assignees or licensees, all moral rights of the entrant in each such Submission; (iv) acknowledges and agrees that such Submission submitted by such entrant may be edited or modified, in whole or in part, by the Sponsors, in their sole and absolute discretion; (v) releases, indemnifies and saves harmless the Sponsors (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, causes of action, damages, costs or expenses brought against or suffered or incurred by the Indemnified Parties, or any of them, arising out of or in connection with the participation by the entrant in this Contest, any breach by the entrant of the foregoing representations, warranties or agreements or the use, in whole or in part, by any of the Indemnified Parties of any Submission submitted by the entrant in this Contest.
- PRIZES
- There are a total of twenty (20) prizes available to be won in the Contest.
- Grand Prize: There is a total of one (1) grand prize available to be won. The grand prize consists of a return economy air transportation for two (2) from the major Canadian international airport nearest to the winner's home to Miami, Florida, three (3) night's accommodations (double occupancy, standard room) ground transportation between the airport in Miami and the hotel, two (2) tickets to attend the Super Bowl XLI on February 4, 2007 in Miami, Florida; ground transportation to and from the Super Bowl game and five hundred dollars ($500 CAD) spending cash. All other expenses not expressly specified as being included in the Grand Prize (including, but not limited to, transportation between the winner's home and to the airport, meals, or expenses or any other costs not specifically listed above as being included in the prize package) are the responsibility of the winner and his/her guests. The winner and his/her guests must travel together. Guest of the winner must be of the age of majority in their respective province or territory of residence. Winner and guest must have, and are responsible for obtaining, all required travel documentation, including passports and visas, if any, and must travel together from the same departure airport. If for any reason, the selected entrant chooses not to accept the prize as offered or is unable to attend at the designated time, the prize will be forfeited by that entrant and the Contest Sponsor reserves the right to select another eligible entrant at random as a possible winner. The Contest Sponsor makes no express or implied warranties of any kind with respect to safety, or performance, of the prize. Approximate total value: $10,000 CDN.
- Secondary Prize: There is a total of one (1) secondary prize available to be won. The secondary prize consists of a 55" Hitachi Plasma HDTV, a Bell ExpressVu 9200 HD PVR receiver, one (1) year of free HD programming and a one (1) year free subscription to next year's NFL Sunday Ticket package on Bell ExpressVu. Approximate total value of $6402.99. Bell ExpressVu service is available only where access and line of sight permit. Other conditions apply. The winner of the Secondary Prize will be subject to Bell ExpressVu's Terms and Conditions.
- Third Prize: There is a total of one (1) third prize available to be won. The third prize consists of a 42" Hitachi Plasma HDTV, a Bell ExpressVu 9200 HD PVR receiver, 1 year of free HD programming and a one (1) year free subscription to next year's NFL Sunday Ticket package on Bell ExpressVu. Approximate total value of $3378.00 Bell ExpressVu service is available only where access and line of sight permit. Other conditions apply. The winner of the Third Prize will be subject to Bell ExpressVu's Terms and Conditions.
- Weekly Prizes: There are a total of seventeen (17) weekly prizes available to be won. Each weekly prize consists of a package of NFL gear including a Coach's sideline hot jacket (approximate value: $99.99, a Replica jersey (approximate value: $99.99), a team logo t-shirt (approximate value: $19.99), a Draft day sideline hat (approximate value: $34.99). Approximate total retail value of each weekly prize pack: $254.96.
- VERIFICATION AND DRAWING
Based on the criteria set out in Section 4. Methods of Entry and in compliance with Section 3. Eligibility, and Section 9. Awarding of Prize(s) and all other rules stated with regard to "Who's Your Team Fantasy Football Pool" contest.
All prizewinners are unofficial for a one week period after the completion of a given contest period. In the event there is a discrepancy please notify Fantasy Sports at the following e-mail address: info@fantasysports.ca within the one week period, otherwise the standings and prize winners will become final and official.
Weekly Prizes: Each week on Tuesdays, starting with Tuesday September 12th and continuing until Tuesday January 2nd, at 10:00 am EST at 100 Wynford Drive in Toronto, Ontario, one (1) weekly winner will be verified from all entrants that participated in the Contest Pool the week prior.
Grand, Second and Third Prizes: On Monday, January 8, 2007 at 10:00am (EST) at 100 Wynford Drive Toronto, Ontario, three (3) entries including the Grand prize, Secondary and Third prizes will be verified from all entries received during the Contest Period.
- ODDS OF WINNING
The odds of winning depend on the number of valid entries received during the Contest Period.
- AWARDING OF PRIZE(S)
- To be declared a winner, a selected entrant must, in addition to meeting the Contest eligibility criteria and otherwise complying with the official Contest rules, first (the "Winner"):
- Be reached by telephone by the Sponsor or its representatives within ten (10) days immediately following the selection of the entry;
- Have correctly answered a mathematical skill-testing question set out on the declaration and release documents; and
- Sign the Sponsor's form of declaration and release and return it to the Sponsor or its representatives at the address indicated on the declaration and release form within fifteen (15) days following its delivery by the Sponsor or its representatives.
- Disqualification: If any one of the conditions mentioned above is not met, the selected entrant will be disqualified and shall not be entitled to receive any prize, and the Sponsor reserves the right, in its sole and absolute discretion, to select at random another eligible entrant as a potential prize winner.
- Prizes Delivery: Following receipt of the selected entrant's signed declaration and release form, the Sponsor or its representatives will send the prize to the winners. Please allow eight (8) to twelve (12) weeks for delivery.
- GENERAL TERMS AND CONDITIONS
- Verification of Entries: The validity of any contest entry is subject to verification by the Sponsor. Any illegible, incomplete or fraudulent entries will be rejected. Any entrant or other individual who enters or attempts to enter the Contest in a manner which is contrary to these official Contest rules or which is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants will be rejected and that entrant or purported entrant will be disqualified. All decisions of the contest judges, who may be employees or independent contractors of the Sponsor, with respect to any and all aspects of the Contest, including without limitation the eligibility or disqualification of entrants, are final and binding without right of appeal. All entries become the property of the Sponsor and none will be returned.
- Acceptance of Prizes: All prizes must be accepted as described in these rules and cannot be transferred to another individual, substituted for another prize or exchanged in whole or in part for money, subject only to what is set out in Rule 10.3 below.
- Substitution of Prizes: The Sponsor reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute for any prize, or part thereof, a substitute prize of equivalent or greater value, including without limitation a cash award.
- Number of Prizes/Winners: By entering the Contest, each entrant acknowledges that the Sponsor shall not be required under any circumstances to award more prizes than the number of available prizes, as set out in these official Contest rules. In the event that, for any reason whatsoever (including without limitation, as a result of an error, malfunction or defect in the design, advertising, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise) the number of declared winners or the number of prizes claimed by entrants is greater than the number of prizes available, the Sponsor reserves the right, in its sole and absolute discretion, to end the Contest in whole or in part, without notice, subject only to the prior approval of the Régie des alcools, des courses et des jeux, if required, in respect of the Province of Quebec, and to award the correct number of prizes among the correct number of winners, selected in accordance with these contest rules from among those eligible entries validly submitted prior to the termination of the Contest.
- Other Termination of Contest: Without limiting the provisions of Rule 10.4 above, the Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including without limitation any virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of the Sponsor, that could corrupt or affect the administration, security, impartiality or normal course of the Contest.
- Release and Exclusion of Liability - General. By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Contest Group Entities, and their respective officers, directors, employees, shareholders, agents and other
representatives (collectively, the "Releasees") from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant's participation or attempted participation in the contest, compliance or non-compliance with these contest rules and acceptance and use of the prize; and (ii) if selected as a potential winner, to sign the Sponsors' form(s) of declaration and release documentation in this regard before receiving his/her prize. Guests of the Grand Prize winner must also sign the Sponsor's forms of Declaration and Release documents as a condition of being permitted to accompany the winner on the Grand Prize trip. The Releasees will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the contest website during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person's or any other person's participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
- Name/Image of Winners: By entering the Contest, each winner authorizes the Sponsor and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use his or her name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration.
- Communication with Entrants: No communication or correspondence will be entered into with entrants, except for those individuals who have opted to receive additional information.
- Personal Information: The personal information gathered about entrants in connection with this Contest will be used solely for the administration of the Contest and is subject to Bell's privacy policies, which are available at www.bell.ca/bellprivacy. No communication unrelated to the Contest, commercial or otherwise, will be sent to the entrant by Bell, unless the entrant has otherwise authorized Bell or one of its affiliates to do so.
- Identity of the Entrant: For the purposes of these rules, the entrant is the person whose name appears on the Bell ExpressVu account, in the case of other entries or, in the case of mailed entries, the person whose name is submitted as the entrant. It is to this individual that the prize will be awarded if selected and declared as the winner.
- LIMITATION OF LIABILITY: Sponsors and Administrators assume no responsibility or liability for lost, late, misdirected or incomplete Entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry). Sponsors and Administrators are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of Entries in the Contest. Sponsors and Administrators assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Sponsors and Administrators are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Sponsors and Administrators are not responsible for any injury or damage to Entrants or to any computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors and Administrators which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, and the Sponsors reserve the right at their sole discretion to cancel, terminate, modify or
suspend the Contest.
- ONLINE ACCOUNT HOLDER INFORMATION: In the event of a dispute regarding who submitted an online entry, the Entry will be deemed submitted by the authorized account holder of the e-mail address, submitted at the time of entry. Authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Selected Entrants may be requested to provide Sponsors with proof that they are the authorized account holder of an e-mail address associated with the winning entry.
- PRIVACY: By entering the contest, Entrant agrees to (a) CANOE's use of Entrant's personal information for the purposes of administering this Contest and, unless otherwise specified, for market and consumer research purposes; (b) disclosure of the entrant's personal information on this entry form to third parties within the CANOE Network; and (c) CANOE's use of entrant's personal information as described in CANOE's Privacy Policy at:
http://rapids.canoe.ca/cgi-bin/reg/NR-register.pl?LANGUAGE=EN&MODE=PRIVACY_POLICY&LOOK=CANOE. To the extent that CANOE, as one of the Sponsors, collects, uses and discloses to third parties your personal information, it will do so only for the purpose of administering the contest and awarding prizes.
- LAWS. These are the official Contest Rules. This Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors.
- TERMINATION: Sponsors reserve the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice.
- DISPUTE RESOLUTION: In case of dispute in regards to this contest, entrant should visit http://www.canoe.ca/Help/ to submit your contest query.
- Dispute - Québec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for resolution. Disputes about the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
